Nikolay’s specialist practice areas are antitrust law, the legislation on state purchases and on trade.

Nikolay Voznesenskiy has extensive experience of providing legal support for Russian and international companies, co-ordinating work on major client projects in the metals, fuel and energy, car and food industries, production of industrial equipment, trade and services, including financial services.

Nikolay advises major Russian and foreign companies on a broad range of antitrust law matters: prevention of monopolistic practices (agreements and concerted actions, co-ordination of economic activities, abuse of dominant position), drafting of petitions and notifications to the antitrust bodies, liaising with the antitrust bodies during audits, development of programmes for observing the antitrust legislation and study programmes. He also acts for clients before the antitrust bodies.

Nikolay has fulfilled a significant number of projects on organising contractual relations within the scope of dealership networks, promotion of financial services, structuring of a system for selling prepaid goods and services (non-bank cards, gift vouchers). Voznesenskiy has participated in introduction by international companies of option models and employee profit-sharing plans in Russia and has taken an active part in their implementation in practice.

For several years in a row, Nikolay Voznesenskiy has been identified by Global Competition Review’s (GCR) independent research as being among the world’s leading Competition lawyers. Nikolay is also mentioned among world’s leading practising antitrust lawyers in Who’s Who Legal, he is ranked in Band 1 by Chambers Europe 2017, recommended by the Legal 500 2017 and selected by peers for inclusion in The Best Lawyers in Russia 2018 Edition in the fields of Competition Law and Litigation. Nikolay was also named Competition and Antitrust Lawyer of the Year, according to Corporate LiveWire Awards 2016.  

Projects

Some of the projects implemented by Nikolay include support for:

  • Baker Hughes in representing in the complaint filed by a Gazprom’s subsidiary with the Russian anti-monopoly regulator claiming that our client was violating the terms of a tender for providing drilling equipment for the Kirinskoye gasfield.
  • Zeppelin Russland in supporting during a dawn raid conducted by the FAS Cartel Department in its joint investigation with the Eurasian Economic Commission’s Antirust Department.
  • NPK Katren in advising on matters involving anti-bribery policies and a range of antitrust matters, including compliance requirements, supply and shortage of goods, etc.
  • OAO NOVATEK in a dispute with Nefte Petroleum Limited in relation to their joint venture Yargeo, the Yarudeyskoye oil field operator in the Yamalo-Nenets Autonomous Area. The project involved our legal assistance to the client at the pre-trial dispute resolution stage and representation of  NOVATEK before the first instance and appeal courts, which considered the claims for Nefte Petroleum Limited to be excluded from Yargeo LLC. Our client's claims were satisfied in full, following which, during the appeal proceedings, the parties reached an amicable agreement.
  • OMK (a major Russian manufacturer of large-diameter pipes) in a case regarding an alleged cartel: division of the large diameter pipe market for construction of trunk pipelines. During the court hearings, it was proven that the parties to the agreement should be released from liability by virtue of achievement of a positive socio-economic effect.
  • Media-Markt-Saturn in a case concerning alleged concerted price-setting actions by competitors. Despite the guilty verdict handed down by the FAS for the Republic of Tatarstan in March 2013, the Federal Arbitration Court for the Volga Circuit issued a judicial ruling reversing the anti-trust body’s decision and stating that our client’s actions demonstrated no signs of breaching the anti-trust legislation.
  • One of the biggest private companies in the oil and gas sector in a case challenging the company’s alleged dominant position and in a project for developing an anti-trust risk tree for the company, together with a financial assessment of their weight and potential consequences for the company should they materialise (in conjunction with engaged economists).
  • Russian Platinum Group – advising on a number of strategic and tactical aspects of a project to develop one of the world’s largest mineral deposits, including support and representation on a number of disputes with the local authorities and in Federal Antitrust Service.
  • The Volkswagen Group and other major car manufacturers in drafting dealership agreements, including optimisation of existing distribution systems, identification and minimisation of antitrust law risks; legal structuring of business processes and financing of warranty repairs, servicing and additional warranty obligations.
  • Mars, Danone and a number of other leading FMCG companies in relation to antitrust trade regulation and legislation in connection with agreement drafting, marketing and advertising campaigns, development of study and information programmes on observance by company employees of the antitrust legislation, representation of interests before the Federal Antimonopoly Service and its territorial bodies;
  • A major building materials producer in liaising with the Federal Antimonopoly Service and advice on competitive pricing and marketing policy.
  • The financial subdivision of a car manufacturer on structuring business processes entailing provision of financial, advertising and marketing services, co-operation with credit institutions and insurance companies.
  • A major catering services supplier in developing a comprehensive system for distributing non-bank prepayment cards and gift vouchers and in structuring relevant cash flows and contractual relations.
  • NP RusBrand in developing a number of legislative initiatives, amendments and bills, and assessing several draft laws on antitrust and trade regulation (including on a gratuitous basis).

Nikolay takes an active part in the work of the FAS of Russia Expert Council on development of retail competition and NP Competition Support under the FAS of Russia, and has written a number of research and practice articles for the journals "Khozyaistvo i pravo" (Economy and Law), "Gosudarstvo i pravo" (State and Law"), "Korporativniy Yurist" (Corporate Counsel), etc.
